"The decision of the Department of Justice (DoJ) that 197 people can be prosecuted for multiple murders in the deaths of 57 people in the November 2009 Maguindanao massacre, based largely on "positive identification" could be a concern. In order for the case to have the possibility of securing a conviction in trial, it cannot afford to depend largely on witnesses' oral testimonies and on the principle of "positive identification" alone.

In a country like the Philippines, where the public prosecutors and court judges still rely heavily on oral testimonies for deciding a "probable cause" to go for trial or to convict a person respectively, the prosecution of cases face the risk of being dismissed for lack of evidence or that the entire case could collapse once witnesses recant their testimonies or have their credibility questioned.

Twenty Four years after the EDSA “People Power Revolution” the greater majority of the Filipino people still wallow in poverty and deprivation, evermore oppressed and exploited. All the promises of EDSA totally unfulfilled.

After 24 years no genuine land reform has been implemented. In a way the bogus Comprehensive Agrarian Reform or CARP succeeded in redistributing prime agricultural lands to tenants, but only to be foreclosed by the Land Bank and delivered to imperialist agri-business. The CARP freed some tenants from landlords only to become farm workers of the multi-national agribusiness and stock sharing schemes of big landlords like the Cojuangco’s Hacienda Luisita. To complete the sacrifice of the land and tenants to the altar of multinational corporation gods, the Arroyo government extended the CARP.

And of the promised national industrialization? What we have are assembly sweatshops and a deluge of extraction companies like logging, mining and fishing - controlled by imperialists which relentlessly deplete our natural resources and destroy our environment. These companies are given free reign by the series of corrupt governments led by the landlord class such as the Cojuangco-Aquinos to exploit our national resources and labor force.

'The War on Terror Myth' By Erick San Juan (Makati City)

HOURS after the September 11, 2001 bombing of the World Trade Center and the Pentagon, the Bush administration was quick to put the entire blame on Al Qaeda, particularly to Osama Bin Laden as the culprit sans investigations. Later, on that same day, the global war on terrorism (GWOT) was officially launched. Since then, countries including the Philippines and in other parts of the globe followed suit by creating government agencies that will address the war on terrorism and even drafted laws to fight terrorism in all fronts.

In October 7, 2001 US troops bombed and invaded Afghanistan where the CIA-created Al Qaeda and its “resurrected” leader, Osama Bin Laden were reportedly hiding.

For over eight years now, the GWOT is still on. Though the 9/11 Truth Movement and other investigative organizations are gaining ground in propagating the truth about 9/11 through the internet and in the different media outlets. Why? Without an "outside enemy", there could be no "war on terrorism". The entire national security agenda will collapse "like a deck of cards". The war criminals in high office would have no leg to stand on.” (Michel Chossudovsky)

Yes, that “outside enemy” lives on and continues to threaten the world in order to justify the presence of US, NATO and its allied troops in Afghanistan where the “immortal” Osama allegedly hides. But the real score was not revealed to the world until several researchers and writers on the internet exposed the hidden agenda of the war on terror which is drugs and its trafficking in Afghanistan.

“This Afghan-Pakistani border region (Spin Boldak) has long been awash in opium, which is grown in Afghanistan and then generally smuggled west to the Balkans, via Iran and Turkey, or shipped out of the port of Karachi to the Gulf states and Africa. The trade boomed during the eighties, when both the CIA and the Pakistani government were happy to turn a blind eye to the drug operations of the mujahideen fighters in Afghanistan, since it helped fund the war against the invading Soviet Union.

After the Soviets left, the drugs remained, and since then opium production in Afghanistan has increased fourteen-fold, from around 500 tons in the mid-1980s to 6,900 tons this year. Sadly, the world was taken for a ride all these years. The myth that there is really a group of terrorists and that those countries should continuously wage war on terror even after Bush, Jr. left office. The current US president, Barack Obama sustained such operations by sending additional troops to Afghanistan.

It seems that this will go on much longer than we expected, for the money they get from illicit drug trade actually “saved” several banks in the wake of the global financial crisis as reported by Antonio Maria Costa, head of the UN Office on Drugs and Crime. This only proves how lucrative for the protectors and operators of the so called “war on terror” is.

It is almost four years since I left the Philippines on voluntary exile. My residence changed each year, at least five times in the last four years. I have lived a rather nomadic life in search of a most elusive truth, asking questions as I wandered from place to place: "Why is my country deteriorating, rapidly sinking in the mud of corruption; official lies and injustice? Why is social inequality worsening? Why is the Church losing its moral and prophetic voice at a time when it is most needed? What is my purpose, my place in this world of compromise, of ever shifting loyalties; convenient, commodified truth? Why is there betrayal; rejection; persecution; marginalization and the trivialization of relationship? Who and what is a real friend? Where and what is a real Church? Who and what is a real follower of Christ?" By February 17, it would have been four years since I left for China in 2006. In the last four years answers to the questions did not come easily and clearly. Slowly, though, I have received some clarity and inner peace. All that hurt; anger; resentment and alienation due in part to what I have said and done in the past have revealed their inner roots and their outer sources of nourishment. I had to go away, be distant and invisible to be more present to that within me which is a source of pain; suffering; confusion and injustice in others. A quote in "The Open Road," Pico Iyer's book about the Dalai Lama seems to capture what I have gone through and continue to struggle with, "It is the only thing we can do, Klaas, I see no alternative, each of us must turn inward and destroy in himself all that he things he ought to destroy in others." (Etty Hillesum, on her way to her death, at twenty-nine in Auschwitz, in Open Road by Pico Iyer, p. 205) I have gradually returned to active involvement in Philippine realities but not fully. I struggle to maintain the necessary tension between social engagement and inner transformation. Hillesum's counsel "to turn inward and destroy in oneself all that one thinks he ought to destroy in others," rings loud and clear in my mind and heart. It was in this frame of mind and state of soul that I was informed about my "Warrant of Arrest." A media friend calls me up to ask me whether I knew about my Warrant of Arrest. I was just as surprised as when I was informed about my first warrant of arrest on May 25, 2002, Friday. This time, it was also a Friday, a common practice to make it difficult to post bail which naturally forces the arresting officers to detain the person with the warrant over the weekend. That is the least of my concern. I will face my arresting officers.

'The Advocacy for an Immediate and Long Term Good: The Preservation of the Ayala Watershed' (Media Statement: Silsilah Dialogue Movement)

For two years now Rigid Aggregates Mining Corporation (RAMC) has been making its level best to get the City of Zamboanga to grant its application to conduct exploration and operation activities within the Ayala watershed area. The permit has not yet been given, thanks in no small part to the efforts of several groups to block the grant of this permit.

Although Silsilah was the original oppositor it has since been joined by other groups, notably the Zamboanga City Water District (ZCWD), the Industrial Group of Zamboanga, Inc. (IGZI) and a farmers’ cooperative. The ZCWD already utilizes deep wells to supply the residents of Ayala with piped water; several IGZI members operate canning factories in Ayala in which thousands are employed; the farmers’ cooperative depends on a continuous supply of clean water for their farming activities.

The operations of these three sectors will be greatly threatened if the water coming from the watershed will be compromised by the operation of a mining company.

In spite of the efforts of the oppositors/petitioners against the grant of the permit to RAMC, the government of the City of Zamboanga has not changed its stand of “no opposition” to the RAMC application. Thus the oppositors, which may be referred to as the Advocates for the Preservation of the Ayala Watershed, has undertaken a new tack in this campaign.

Two information sources on the issue have been prepared – one a sourcebook which can be used by groups and institutions to instruct their own people, and a pamphlet which can be more for individual use. Both carry the title The Imminent Destruction of the Ayala Watershed and carry facts and significant, relevant information on the issue. Objective and accurate information goes a long way in getting people to look at a situation as it should be looked at. This was the hope and the rationale that led to the publication of the two materials.

On January 29 at the Silsilah Center in Zamboanga City the two materials were launched. In attendance at the launching were the petitioners, concerned residents of the impact barangays, other concerned individuals supportive of the cause, and members of the media.

Atty. Laisa Alamia, one of the two legal counsels of the oppositors, referred to several Philippine laws that if applied as intended by the respective legislation, will clearly resolve the matter in favor of the position taken by the petitioners.

Among these are the Clean Water Act; the Clean Air Act; the NIPAS Law; the Climate Change Law. There is also a memorandum circular between the Department of Environment and Natural Resources (DENR) and the Department of Interior and Local Government (DILG) defining the responsibility of both government offices to take care of the environment including the watershed.
