Charges filed vs suspects in slay attempt on ARMM official’s youngest brother

ZAMBOANGA CITY – Local authorities said it filed frustrated murder charges against two suspects in the attempt on the life of the youngest brother of a top official of the Autonomous Region in Muslim Mindanao (ARMM).

City Prosecutor Ricardo Cabaron said they have filed charges (Frustrated Murder Case No. 30861) against Al Huzain Hussin and his companion in connection to the shooting of Al-Wijar Mawallil.

Mawallil is the brother of Amir Mawallil, Director of the ARMM’s Bureau of Public Information.

Al-Wijar was shot by two motorcycle-riding men on January 7 while driving his car on the way home at Galvez Drive along Governor Ramos Avenue in the village of Santa Maria here.

The resolution said Hussin, also known as “Alhusiane Hussin y Ibrahim,” was one of the alleged suspects behind the shooting of Al-Wijar. Hussin was Al-Wijar’s friend.

A supplemental Judicial Affidavit executed by Al-Wijar on April 4 said that on the night before he was shot, he slowed down his car as he saw Hussin and his companion allegedly tailing him on a motorcycle.

Al-Wijar said that as soon as Hussin positioned his motorcycle on the driver’s side, his back-rider allegedly shot him and then they sped off.

Hussin, however, submitted a counter-affidavit and other controverting evidence denying the accusations lodged against him. He said he was with his family and friends on January 7.

He also averred and submitted his medical certificate asserting that he was diagnosed with heart ailment thus was advised to avoid strenuous activities including driving a motorcycle hence, making it untrue that he allegedly drove the motorcycle.

Hussin also denied ever receiving text messages from a certain “Toting.” His allegations were corroborated by his witnesses – Mershalene Hamid, Ibrahim Hussin, Nursima Hussin, Algazim Hussin and Aziza Sahid.

The City Prosecutor said Hussin’s companion, whose true name and identity is still unknown, cannot be properly investigated in accordance with the Rules of Criminal Procedure. But the Prosecutor recommended the sum of P200,000 bail bond for each accused.

The Prosecutor added that after careful evaluation and assessment of the evidence on record, he found there is reasonable ground to believe that the crime charged has been committed and that Hussin and his companion, by virtue of conspiracy, appear to be responsible for the same  and are probably guilty thereof.

“The defense interposed by the respondent  being evidentiary in nature can be best determined during the trial of the case,” Cabaron said.

The elder Mawali said they will pursue the case against his brother’s attackers. “We will pursue this case,” Mawallil told the regional newspaper Mindanao Examiner.
