Karapatan ng Sulu Sultanate sa Sabah nawala na parang bula!

ZAMBOANGA CITY (Mindanao Examiner / Mar. 11, 213) – Tuluyan na umanong nawala ang lahat ng karapatan ng Sultanate of Sulu sa inaangkin nitong North Borneo o mas kilala ngayon sa tawag na Sabah.

Ito ang sinabi ng Malaysia’s Bar Council base na rin sa mga papeles at dokumentong hawak ng Kuala Lumpur.

Sinabi ni Bar Council Vice President Christopher Leong na maging ang International Court of Justice ay kinikilala na rin ang Malaysia na siyang may karapatan sa Sabah matapos na pumalya ang Sultanate of Sulu at Pilipinas sa isang territorial dispute nuong 2002.

“The Sultanate of Sulu had, by its several actions and by various separate instruments between 19 April 1851 and 26 June 1946, relinquished and ceded all of its rights, interests and dominion over what was previously referred to as North Borneo,” ani Leong sa isang ulat na inilabas ng Malaysian Insider newspaper.

“The Sultanate of Sulu, even if such an entity were to legally exist today, has no subsisting legitimate claim to Sabah,” wika pa ni Leong at dagdag pa nitong “the ICJ recognised Malaysia’s claim in its decision on the dispute between Malaysia and Indonesia over the islands of Ligitan and Sipadan off the coast of Sabah in December 2002.”

Binigyan umano ng sapat na panahon ang Pilipinas na umapela sa ICJ ngunit ibinasura naman ito ng ICJ.

Iginigiit ng Sulu Sultanate na may historical rights ito sa Sabah na kung saan ay patuloy ang massive assault ng Malaysia laban sa halos 200 mga taga-sunod ni Sulu Sultan Jamalul Kiram III sa pangunguna ng kapatid nitong si Raja Muda Agbimuddin Kiram.

Ipinadala ni Sultan Jamalul ang grupo sa bayan ng Lahad Datu upang patuunan ang karapatan sa Sabah, ngunit pilit naman pinalalayas ng Malaysia ang mga ito at kung kaya’t binakbakan ng husto ng militar ang mga taga-sunod ni Raja Muda Agbimuddin. Mahigit ng 50 ang bilang ng napapatay sa grupo ni Sultan Jamalul at 8 naman sa panig ng Malaysia.

Nanawagan naman ang Bar Council sa Malaysia na resolbahin ng mapayapa ang kaguluhan at respetuhin ang karapatan-pantao ng mga Pilipino, partikular ang mga nadakip na kasamahan o supporters ng Sultanate of Sulu.

“As we seek to assert our rights and protect our sovereignty and territorial integrity, we must continue to conduct ourselves with a strong sense of dignity and professionalism, with due observance of our own laws as well as international laws and standards,” ani Leong.

Umabot na sa 85 katao ang dinakip ng Malaysia mula ng magsimula ang gulo sa Sabah sa ilalim ng Security Offences (Special Measures) Act 2012 na kung saan ay maaaring makulong hanggang 2 taon ang mga dinakip kahit na walang paglilitis.

Naunang umalma ang pamahalaang Aquino sa balitang talamak ang human rights violations sa mga Pilipino sa Sabah at nanawagan ito sa Malaysia na respetuhin ang karapatan ng mga Pinoy doon.

“The Department of Foreign Affairs views with grave concern the alleged rounding up of community members of Suluk/Tausug descent in Lahad Datu and other areas in Sabah and the alleged violations of human rights reported in the media by some Filipinos who arrived in Sulu and Tawi-Tawi from Sabah. We reiterate our call on the Malaysian Government to give humane treatment to the Filipinos under their custody,” ani ng pamahalaan. (Mindanao Examiner)
