Principal, 3 guro nito sa Kidapawan City absuwelto sa kasong child abuse

KIDAPAWAN CITY – Pagkatapos ng halos 13 taon, napatunayan ng korte na walang sapat na batayan ang Prosekusyon para sampahan ng kasong child abuse ang principal ng Amas National High School, at tatlo pa nitong mga guro.

Taong 2007 nang isampa ng isang menor-de-edad ang kasong paglabag sa Republic Act 7610 nang di-siya tanggapin ng Amas NHS bilang fourth year student. Noong 2007, kinakitaan ng prosekusyon na may sapat na dahilan para kasuhan ng Article 6, Section 10, ng RA  7610 o Anti-Child Abuse Act sina Leah Godoy, principal ng Amas NHS; at mga guro na sina Ma. Fe Insular, Rachel Mamacus, at Ferdinand Begornia.

Pero base sa ipinirisintang mga ebidensiya at testimonya mula sa iba’t ibang panig, nakita ni Judge Arvin Sadiri Balagot ng Regional Trial Court Branch 17 na hindi maituturing na child abuse ang refusal ng school official na ipasok sa fourth year level ang private complainant.

Ito ay makaraang mapatunayan nina Godoy na bumagsak sa tatlong mga subjects niya ang private complainant no’ng siya ay nasa second year pa lang. Sa ilalim ng DepEd guidelines, hindi maaaring umakyat sa susunod na year level ang isang estudyante kapag may bagsak ito na tatlong units o higit pa.

Napatunayan nina Godoy na ang private complainant ay bumagsak sa English, Science, at Mathematics.

Kaya’t sa halip fourth year, ibinalik siya sa third year.   Sa siyam na pahinang desisyon, inabsuwelto ng korte sina Godoy at tatlong iba pa sa kasong child abuse.

Pinababalik na rin ng korte ang pyansa nila na abot sa P80,000.

Pero si Insular ay pinababayad ng civil damages na abot sa limang libong piso.   Ito, ayon sa korte, ay dahil si Insular ang adviser sa second year ng private complainant.

At bilang adviser, responsibilidad umano niya na kausapin ang private complainant kung bakit di siya maaaring umakyat sa third year. Ang desisyong ito ni Judge Balagot ay ibinaba niya nito lang May 7 – pagkataos ng labing-isang taon. (Malu Cadeliña Manar)
